We respect your data.  It is our business to ensure that your data remains secure, private and safe.  From a web site visitor to a long term customer, this is our privacy and cookie policy.

Our Terms and Privacy Policy contain much more details, but we wanted to make you aware of the following key points:

*If you chose to use our End-to-End encryption Channels we cannot access your data in a comprehensive way, and we do not intend to collect neither store any data from usage of our services via those Channels for other means than delivering our services. For any other Channels we do not intend to collect neither store any data from usage of our product for other means than delivering our services.

*We may receive data - that can constitute personal data under applicable laws - in order to provide our services. All customer accounts and payments information may be outsourced to and managed by APIfew.com. You can find their Terms and Privacy Policy via the website: www.APIfew.com.

*We do not share or sell any data with third parties for them to advertise their products/services to you.

*We use data to analyse our customers and visitor’s behaviour as a whole and in an anonymised way (never on an individual level). We do this so that we can improve our users’ experience on our website and improve our services.

*We conduct digital advertising campaigns ourselves on Google, social media sites or any other sites to increase awareness of DataBraodcaster. You can opt out of interest-based advertising on those sites if you wish.

We will only send our newsletter to you with your consent and you can opt out at any time.

Introduction

Your privacy is of paramount importance to DataBroadcaster. DataBroadcaster brand is the property of Altair Services SAS a French company referred to in this policy as "DataBroadcaster", "we", "us", or "our".

DataBroadcaster provides a service (the “Service” or “Services”), which is a tool allowing you to broadcast, share, process, interface, publish and visualize data. We fully respect your right to privacy in relation to your interactions with the Service and are committed to being transparent in our dealings with you as to what personal information we will collect and how we will use your personal information. Also, we only collect and use personal information that is necessary for providing the Service and where we have a lawful basis to do so.

We have created this Privacy Policy to describe our practices and procedures in handling “Personal Information” we collect or receive from you. The term “Personal Information” means any information that identifies, relates to, describes, or is capable of being associated with, or could reasonably be linked, directly or indirectly, to an identified or identifiable living natural person, including but not limited to: (i) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, email address, account name, and (ii) information defined as “personal information,” “personally identifiable information,” “personal data,” or similar expressions under applicable privacy laws or data security Laws, which include the European Union’s General Data Protection Regulation (”GDPR”) among others.

This Privacy Policy covers two types of Personal Information:

  • Website Information means information collected while viewing pages on our websites, information you have entered in our contact, download documents, employment forms or other forms, referral URLs and IP address and similar data tracked internally as well as by third parties.
  • Account Related Information means contact information, payment information, and biographical information about our customers’ representatives and contacts used for marketing, opening new user accounts to use our Services, and to maintain existing accounts.

This Privacy Policy does not govern the User Content Data, defined as the data that you or your users that have the permissions to do so, upload, connect, transfer, enter, import or broadcast by utilizing our Service.

Please read this Privacy Policy carefully. We will ask for your consent to be bound by this Privacy Policy as a condition of (i) viewing our web sites and (ii) testing or using our services.

Our website and Services are intended for use by business professionals and adults. We do not knowingly collect Personal Information from users under 13 years of age however we do make our services available for academic institutions.

We may utilise cookies so that we can deliver a seamless experience between our product and our Website and so that we can analyse aggregated usage data (e.g. how many people are returning to our Website more than once). Furthermore, we may use pixel tags within our emails in order to measure the success of our direct marketing campaigns (including our newsletter), and to compile statistics about usage of the services (e.g. how many people are opening newsletter emails).

A cookie is a small file placed onto your browser that enables us to enhance your experience on DataBroadcaster websites and application by remembering your preferences and settings.

DataBroadcaster Cookies are used to store the preferred/selected web site language, the web site that referred the visitor, a unique identifier that can be traced back to the session in the application for activity reporting or to predefined defaults such as region and language preferences.

Additionally, our web site uses Google Analytics which tracks visitors, their page to page activity and duration of each page.  We use these cookies to improve our web site in content and organization and to index it preferentially in Google search.

Web Site Forms

Web Site Forms are used to allow visitors to contact sales staff for commercial questions, employment inquires, and to forward requests for additional information or documents on related topics.

Account Primary Owner Data

We may outsource the account management of our service to the following provider: APIfew.com (trademark of Altair Services SAS)

Users subscribing for the trial and/or paying subscriptions via our website or via any partner are required to enter a set of data, including a valid email address, business name and address. Users not wishing to enter the requested information correctly are not allowed to use our Service. This information is collected to provide notifications of changes of service, and to identify the owner of the account in case of data breach, data misuse, or other topics as it relates to the use of the Service.

Account Payment Data

We may outsource the payment activities of our service to the following provider: APIfew.com (trademark of Altair Services SAS)

If your account is managed via APIfew.com, the Account Primary Owner, upon using our paid services, must add via APIfew.com a payment method. The payment method is not stored in our neither at APIfew.com databases and it is processed by Stripe with registered office in San Francisco, 510 Townsend St, California, United States.

All other data such as: company name, billing address, VAT/TVA or tax identification numbers, company identifiers may be required by us or APIfew.com for accounting practices and used as such. We have no access to such data if your account is managed via APIfew.com

Use of collected data

Data collected from the web site is used in optimizing the web site by changing structure and content.

Data from the web site and/or the account users can be used to send product newsletters, system notifications, alerts, publications as scheduled by the users or by the system as needed such as but not exclusive to, reset password, system thresholds, payment and invoices, new product releases, updates or down times, security alerts, and similar alerts.

DataBroadcaster does not share or sell any personal data with third parties; and we always ask prior consent for non-service usage (such as newsletter emailing).

GDPR

DataBroadcaster operates under General Data Privacy Regulation (GDPR-EU law). When the full business relationship between a Customer and DataBroadcaster is developed via the Customer accessing our Services independently via our website or any other channel, in practice that means that we collect the minimum data necessary to provide DataBroadcaster’s Services and comply to regulation, meaning exclusively the Customer’s email as a login/identification key. If a Customer is entering into a business relationship with DataBroadcaster via a direct sales approach from us, DataBroadcaster might be in a position to hold additional Personal information about the Customer.

We or our partners may request access to the following data in order to process the payments required for a Customer to use DataBroadcaster’s Services.

   *Business name  
   *Address for VAT/TVA calculation and invoicing  
   *Tax identification number  
   *Credit/debit card Numbers

If you are an individual within the European Economic Area, you may have the following rights under applicable data protection law and we, as Data Controller in respect of Account-Related Information or other Personal Information covered by this Privacy Policy, will comply with such rights in respect of such Personal Information:

  • The right of access to Personal Information relating to you;
  • The right to correct any mistakes in your Personal Information;
  • The right to object and ask us to stop contacting you with direct marketing;
  • Rights in relation to automated data processing;
  • The right to restrict or prevent your Personal Information being processed;
  • The right to have your Personal Information ported to another data controller;
  • The right to erasure; and
  • The right to complain to the DPC if you believe we have not handled your Personal Information in accordance with applicable data protection law.

If you are a user working on behalf of an existing XLbroadcaster customer, we have a legitimate interest to send you electronic communications/direct marketing in connection with the Service and related matters (which may include but shall not be limited to newsletters, announcement of new features etc.). We may also ask you different questions for different services, including competitions. We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them. You can ask us to stop contacting you for direct marketing purposes. If you would like to do this, please email us directly. It may take up to 15 days for this to take place; and let us know what method of contact you are not happy with if you are unhappy with certain ways of contacting you only.

Data retention

Any Account-Related Information and other Personal Information will be kept and stored for such period of time as we deem necessary taking into account the business purpose for which it was collected in the first instance (i.e. the administration of Your Account for as long as Your Account is active and a reasonable period thereafter in case you decide to re-activate Your Account), and our obligations under applicable data protection law.

This may include retaining Account Related Information or other Personal Information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Services.

Where we retain Personal Information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Service, not to specifically analyse personal characteristics about you.

If you need to contact us with regard to any of your rights as set out in this Policy, all such requests should be made in writing by email to contact@databroadcaster.io RESOLVING DISPUTES If you do not think that we have processed your Personal Information in accordance with this Privacy Policy, please contact us in the first instance. You may submit a complaint to us via email. Once we receive a privacy complaint, our privacy team will investigate your complaint and give you a response. We will need sufficient information from you for us to evaluate your complaint and, as a result, we may request that you give us additional information that we believe is necessary to assess your complaint. Dispute resolution proceedings will be in English.

Changes to privacy policy

DataBroadcaster may change its Privacy Policy from time to time and at its sole discretion. The date of the most recent revisions will appear on this page. If you do not agree to these changes, please do not continue to use the Service, to submit Account-Related Information or other Personal Information to us. If material changes are made to the Privacy Policy, we will notify you by placing a prominent notice on our website or by sending you a notification in relation to this. We will not process Account-Related Information in a manner not contemplated by this Privacy Policy without your consent.
